These terms cover what we build for you, what it costs, who owns what, and how either of us can end it. Using our website or buying a plan means you accept them.
1. Who these terms are between
Gold Strategics of Lake County, Florida, and you, the client. If you are agreeing on behalf of a business, you confirm you are allowed to do that.
2. The plans
| Plan | Monthly | Build fee |
|---|---|---|
| Gold, the website | $80 | $250 once |
| Business Operating System, the website and the tools | $349 | $500 |
Gold covers a custom website, hosting, security, backups, intake forms, the visitor dashboard and the instant answers widget, for one location and one service area. The Business Operating System includes the following, and nothing that is not on this list: Website: Multi-page, SEO optimized, Intake forms, Fully custom, Career forms, AI optimized, AI chatbot. Tools: CRM, Automated follow-up and reminder tool, Visitor analytics dashboard, Online booking and scheduling with deposits, Two-way texting, Review builder, Knowledge management system. Services: Online presence audit, Google Business Profile optimization, Priority website changes.
Tools can also be fitted to a website we did not build. In that case you keep your existing host and we run the tools alongside it. What we can install may depend on how your current site is built, and we will tell you before you pay if something will not work.
Other services, including the website accessibility service in section 14, are priced in writing before any work starts.
3. Payment
The build fee is due before work begins. Plans and tools bill monthly in advance from the date you start. Prices are in US dollars.
Paying for a year up front. The Business Operating System can be prepaid annually for ten months of the monthly price instead of twelve. The build fee is separate and is not part of the prepayment. Prepaying does not create a minimum term: if you cancel part way through a prepaid year, we refund the whole months you have not used, within ten business days of you asking. The month you are in is not refunded.
If a payment fails and is not resolved within a reasonable period after we tell you, we may suspend the website and any tools until the account is current. We will always contact you first, and suspension is a last resort rather than an automatic one.
4. Cancelling
There is no contract and no minimum term. To cancel, email us at least five business days before your next billing date. Cancellation takes effect at the end of the current billing period, and partial months are not refunded. Adding or removing a tool works the same way.
The 90-day guarantee on the Business Operating System. If you cancel within ninety days of your start date, for any reason, we refund the build fee in full within ten business days of you asking. There are no conditions on it and nothing for you to prove. Monthly fees cover the months the system ran and are not refunded, and the site and domain stay in your name either way. Other one-time fees are not refundable once work has begun.
5. What we deliver, and when
Most builds go live within a few days of you sending your content, photos and details. That timeline depends on you: if we are waiting on material from you, the clock waits too.
Before launch we show you the site and make reasonable revisions. Requests that go well beyond the agreed scope, such as custom functionality that is not part of any plan, are quoted separately before we start them.
6. Ownership
- Your domain is registered in your name and stays yours.
- Your content stays yours. Text, images, logos and anything else you give us remain your property.
- Your website is yours. If you cancel, ask and we will hand over the site files and your customer data.
- The exit kit. On the Business Operating System we do not wait to be asked. In the first week we hand you the domain registered in your name, a copy of the site files, your lead and customer data as a spreadsheet, owner rights on your Google Business Profile, and a one-page written handover. You can ask for a current copy of any of it at any time, and nothing in these terms makes it conditional on your account being in good standing.
- Our underlying tools and templates remain ours. You get an ongoing right to use the site and tools we delivered to you, but the reusable code behind them is not sold or transferred.
7. Your customers' data
Some tools handle information about your customers: inquiries, contact details, job records, and messages sent on your behalf. That data is yours. We handle it only to run the service you are paying for, we do not sell it, and we never use it to market to your customers on our own behalf. Section 6 of our privacy policy sets out how we treat it.
Your side of this. Where a tool contacts your customers, you confirm you have a lawful basis to contact them and that the lists you give us are yours to use. You are responsible for complying with the marketing and messaging laws that apply to your business. We will not send to a list you cannot account for, and we may refuse or stop a send that looks unlawful.
8. What you are responsible for
- Giving us accurate information about your business, your services and your prices.
- Holding the rights to any content, photographs or logos you send us.
- Keeping your own account credentials secure.
- Using what we build lawfully.
9. What we do not promise
We do not guarantee search rankings, positions in AI assistants, traffic volumes, lead numbers or revenue. Nobody can, and anyone who does is selling you something. What we commit to is doing the work described in your plan competently and on time.
Our services are provided as is. We aim to keep sites available and working, and we monitor them, but we do not warrant uninterrupted or error-free operation. Hosting, domain registrars, email providers and other third parties can fail in ways outside our control.
10. Limitation of liability
To the fullest extent permitted by law, our total liability for any claim arising from our services will not exceed the amount you paid us in the three months before the claim arose. We are not liable for indirect, incidental or consequential damages, including lost profits or lost business opportunities.
11. Ending it from our side
We may suspend or end service for non-payment, for unlawful use, or if a client is abusive to us. Other than for non-payment or unlawful use, we will give you reasonable notice and hand over your site files and data.
12. Governing law
These terms are governed by the laws of the State of Florida. Any dispute will be resolved in the state or federal courts located in Florida, and you consent to their jurisdiction.
13. Changes to these terms
We may update these terms. Material changes will be reflected in the date at the top of this page, and existing clients will be told by email before a change affects them. Continuing to use our services after a change means you accept the updated terms.
14. Website accessibility services
We test websites against the Web Content Accessibility Guidelines (WCAG) 2.1 at Levels A and AA, fix what we find, write an accessibility statement and policy, and produce dated test reports, including a report every three months if you subscribe to them.
We are not lawyers, and this is not legal advice. Nothing we say or deliver is a legal opinion, including anything about a lawsuit, demand letter, settlement or the Americans with Disabilities Act. Decisions about any legal matter belong to you and your lawyer.
- No guarantee of compliance or of any legal outcome. We do not promise that your website is or will be "ADA compliant", that our work will prevent a lawsuit or demand letter, or that it will end, settle or reduce any claim. WCAG 2.1 Level AA is the standard we test against because it is the one courts and settlements cite most often.
- The limits of testing. Automated tools find only part of the problems a website can have. We add testing by hand with a keyboard and a screen reader, but no test finds everything, and each report describes only the pages, tools and date written on it.
- Not expert witnesses. Our reports record test results. We do not act as expert witnesses or prepare expert reports for a court unless we agree to that separately in writing.
- Other companies' tools. Ordering, reservation, booking, payment, chat, map and video tools belong to the companies that make them. We test them, fix what your website controls, and document the rest. We cannot change another company's code and do not guarantee it.
- After we deliver. Websites change. Pages, images, menus, documents or plugins added after we finish can bring back problems. Catching those is what the quarterly reports are for. Without them, keeping new content accessible is your responsibility.
- Your part. Give us access to your website platform, tell us about content we cannot see, and tell us about any deadline you are working to.
- Payment and refunds. Half the price is due to start and half on delivery. If our first audit shows your platform will not allow the fixes and you decide not to have us rebuild the site, we refund the first half in full. Otherwise the first half is not refundable once fixes begin. Quarterly reports bill every three months in advance and can be cancelled under section 4.
- Confidentiality. We keep what you tell us about any legal matter confidential, and we send our reports only to you and to anyone you ask us to send them to, such as your lawyer.
Section 10 applies to this service as it does to everything else we do.
15. Website image inventory and replacement
We find and list the images on the website and social pages you name, archive them, and replace the images you choose with your own photos or with stock photos licensed in your business's name.
We are not lawyers, and this is not legal advice. Gold Strategics is a web services company, not a law firm. Our report is a factual inventory of images we located on the pages listed, as of the dates shown, and of the license documents you provided to us. It does not state or imply whether any use is licensed, infringing, or permitted, and it is not an opinion on any claim, demand, or lawsuit. Please have your attorney review our report before acting on it, and before removing any material that may relate to a pending or threatened claim.
- If you have a claim. If you have received a demand letter or have been sued, we will perform this work only at the written direction of your attorney, and we will deliver our report to your attorney.
- Nothing removed without written instruction. We archive full-size copies and dated captures of every page before any change. We remove or replace only the images you, or your attorney, name in writing, and we never delete your originals.
- What we review. Only the pages and accounts listed in our report. Images elsewhere, including third-party sites, apps, marketplaces and archived copies, are not reviewed.
- Replacement images. Your own photos, or photos from Adobe Stock or Shutterstock licensed in your business's name, with the license file kept for each one. License fees are charged at cost and approved by you before purchase. We do not use free photo sites or AI-generated images for this service.
- We never contact the other side. We do not contact any claimant, photographer, agency or their lawyers, and we do not negotiate or comment on any claim.
- No guarantee of any outcome. We do not promise that our work will prevent, end, reduce or settle any claim.
- Payment and refunds. The price is due to start. If we have not begun the inventory, we refund it in full on request. Stock license fees, once bought in your name, are not refundable.
- Confidentiality. We keep what you tell us about any claim confidential and send our report only to you and to anyone you ask us to send it to, such as your attorney.
Section 10 applies to this service as it does to everything else we do.
